2026/02/20
Effective Date: 2026.02.20
Last Updated: 2026.02.20
Version: 1.3
These Terms of Service ("Terms") form a legally binding agreement between you and HappyHorse-1.0, operated by Mindepy, LLC (collectively, “HappyHorse-1.0”, "we", "us", or "our"). They describe your rights and responsibilities when accessing or using the website located at https://happyhorsevideo.org, our web applications, and any related services (collectively, the "Service").
By creating an account, purchasing credits, starting a subscription, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced within them, including our Privacy Policy and Refund Policy. If you do not agree, you must discontinue all use of the Service.
HappyHorse-1.0 allows you to generate, edit, and download AI-powered images, videos, and related digital assets. Features may include free previews, subscription tiers, one-time credit bundles, and promotional campaigns. We continually improve the Service and may add, modify, or remove features at any time.
We do not guarantee uninterrupted or error-free access. Planned or unplanned downtime may occur for maintenance, security updates, or reasons beyond our control.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. You may not sublicense or assign this license.
You agree not to:
You must not request, generate, upload, distribute, monetize, or otherwise use any content through the Service that infringes the intellectual property or proprietary rights of any third party, including copyrighted characters, likenesses, music, film, software, or designs, unless you hold a valid license or other written authorization. We reserve the right to reject prompts or outputs that resemble protected works or other licensed materials.
We process payments through multiple partners (including Stripe, PayPal, and Creem, depending on availability). You agree to comply with the applicable terms, prohibited/restricted business rules, and acceptable-use requirements of each payment channel we enable for your account. Without limitation, you agree not to use the Service to facilitate goods, services, or activities that fall within any of the following representative categories:
Payment partners may require enhanced due diligence for certain restricted businesses—including content creation platforms that monetize third-party content, crowdfunding, dating services, cyberlockers, CBD products, cryptocurrency exchanges or wallets, investment and lending services, pharmaceuticals or telemedicine, tobacco products, stored value programs, precious metals, high-value travel services, and other regulated industries. You must not use the Service for these categories unless we provide prior written consent and the relevant payment partner confirms eligibility.
We may suspend or terminate your access to the Service, refuse to fulfill prompts, or remove content if we believe your activity violates payment channel requirements, applicable law, or these Terms. We may update this section at any time to reflect policy changes from our payment partners.
We reserve the right to investigate violations and to suspend or terminate accounts that breach this section.
All copyrights, trademarks, trade secrets, and other intellectual property in the Service, including the software, templates, text, graphics, logos, and brand elements, belong to HappyHorse-1.0 or our licensors.
You retain ownership of any original content you upload or submit to the Service. By providing content, you grant us a worldwide, royalty-free, non-exclusive license to host, store, and display your content solely for the purpose of operating and improving the Service.
If you volunteer feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without obligation to you. Feedback is not treated as confidential information.
Our Service integrates with third parties, including payment processors, analytics providers, and content delivery networks. Those third parties operate under their own terms and privacy practices. We are not responsible for third-party services and disclaim liability for their acts or omissions.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY LAW, HappyHorse-1.0 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS (USD $50).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you. In that case, our liability will be limited to the extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless HappyHorse-1.0, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your access to or use of the Service, (b) your breach of these Terms, or (c) your infringement or violation of any third-party rights.
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, our policies, or applicable law. Upon termination, your right to use the Service will end immediately. Sections that by their nature should survive termination (including payment obligations, intellectual property, limitations of liability, indemnity, and dispute provisions) will remain in force.
You may delete your account at any time through your dashboard or by contacting support. Termination does not relieve you of obligations incurred prior to termination.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be submitted to binding arbitration in Delaware, except that either party may seek injunctive relief in a court of competent jurisdiction.
If arbitration is prohibited where you live, disputes shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
We may update these Terms from time to time. When we make material changes, we will post the revised Terms on the Service and update the "Last Updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Happy Horse Video may schedule an eligible unpaid account for deletion after at least 30 consecutive days without recorded activity. A scheduled account receives 30 days' advance notice and a reminder seven days before deletion. Signing in or selecting the keep-account confirmation cancels the schedule. This rule excludes accounts with successful payment history, an active subscription, or refund, chargeback, or dispute history. Any unused free or promotional credits expire when the account is deleted.
